Approval of the terms of reference for the Mayer Landfill Expansion Environmental Assessment

Notice of approval – terms of reference

As provided for by Section 6(4) of the Environmental Assessment Act, Terms of Reference, as submitted for approval to the Ministry of the Environment on May 14, 2001, to govern the preparation of an environmental assessment for the above-noted undertaking, is hereby approved with the following amendments:

1. The last sentence of the first paragraph in Section 4.0 shall be changed to read: The preferred alternative method of carrying out the proposed undertaking will be addressed in the EA. Similarly, the first sentence in the third paragraph of Section 4.0 shall be changed to read: The following is the preferred method of addressing the Domestic Landfill expansion component that will be evaluated for this EA:
2. A statement shall be added to page 4, after the last sentence of Section 4.0, which reads: Alternative design and operation concepts, including engineered landfill management systems to address potential leachate collection and treatment requirements as well as other landfill management issues, will be evaluated in the EA.
4. The Terms of Reference require the proponent to implement a comprehensive consultation plan outlining the timing and types of consultation that will occur during the preparation of the environmental assessment. In addition, there will be additional opportunities for public and agency consultation when the environmental assessment is submitted to the ministry.
5. Amendment 1 provides flexibility in the EA by clarifying that the stated method of carrying out the undertaking is preferred.
6. Amendment 2 addresses public and agency concerns that were raised during the review of the ToR. As stated in a letter dated June 18, 2001, the proponent wishes to clarify the ToR to state that the EA will contain a study of alternative landfill management systems.
7. Amendment 3 reflects the correct noise criteria to be considered in the assessment of noise impacts.
8. Amendment 4 clarifies that potential life cycle impacts of the proposed landfill expansion that will be considered in the EA will include the construction, operation, maintenance, retirement and rehabilitation of the landfill.
9. Amendment 5 clarifies that the monitoring and mitigation plans that will be developed in the EA will include groundwater, surface water, landfill gas and other monitoring/mitigation plans, as required.
