Notice of approval – terms of reference

As provided for by subsection 6(4) of the Environmental Assessment Act (EAA), the Amended Terms of Reference (ToR), as submitted for approval to the Ministry of the Environment on August 24, 2010 to govern the preparation of an environmental assessment (EA) for the abovenoted undertaking, is hereby approved with the following amendment:

  • The Amended ToR shall be further amended to include as part of the ToR the errata letter submitted to the Ministry of the Environment on September 9, 2010. The errata letter shall form part of the Amended ToR.

Pursuant to subsection 6.1(1) of the EAA, any EA for the above-noted undertaking, submitted to the Ministry of the Environment pursuant to subsection 6.2(1) of the EAA, must be prepared in accordance with the Amended ToR as hereby approved.

Reasons

I am satisfied that an EA prepared in accordance with the ToR, as amended, will be consistent with the purpose of the EAA and the public interest for the following reasons:

  1. The Amended ToR ensures that the EA should be completed using a comprehensive public, Aboriginal and government agency consultation process that is open and transparent;
  2. The Amended ToR ensures that the completed EA should contain a sufficient level of detail to accurately assess the environmental effects of the alternative methods and the proposed undertaking; and,
  3. The Amended ToR sets out a planning process that will ensure the completed EA should be consistent with the purpose of the EAA and the public interest.
